WILL OF HENRY ROBERTS

In the name of God Amen, I Henry Roberts of said county and state bing of sound and deposing mind and memory, and knowing the uncertainty of life, and being desirous of settling my worldy affairs do hereby make publish and declare this is my last will and testament in the following manner and form.

ITEM I: I desire and direct that my body be buried in a decent and Christian like manner and my worldly estate I give and devise as following:

ITEM II: I devise and direct that the amount due my grand-child Louisiana Roberts from her father, John Moore, be paid to her legally appointed guardian after deducting the necessary expense of a law suit for collecting the same.

ITEM III: I give and bequeath to my son John Micajah Roberts my watch to him and him forever.

ITEM IV: Whereas I have heretofore settled by deed upon my beloved wife Martha L. A. Roberts a certain lot or parcel of land known as the place on which she lived previous to her marriage with me: now therefore this item of my last will and testament is to confirm the same to her, and her heirs forever, and I hereby give to my beloved wife full power to dispose of the same by will or otherwise.

ITEM V: I desire and direct that the residue of my estate both real and personal whatsoever and wheresoever the same may be shall be equally divided between my beloved wife Martha L. A. Roberts, my son, John Micajah Roberts, my daughter Martha Penina Roberts and any other child or children my said wife may have during coventure with me, each share and share alike.

ITEM VI: In the event of the death of my beloved wife, M. L. A. Roberts or either of my children mentioned in Item 5th of this my last will and testament, I do desire and direct that any and all property bequeathed to them shall go to and be vested in the survivor or surviving. And in the event of the death of my beloved wife Martha L. A. Roberts and all the children she may have during coventure with me then and in that event I give and devise the whole of my estate, both real and personal, to my son William H. Roberts and my daughters Margaret Kelly and Narcissa Crawford, each share and share alike to them and their heirs forever.

ITEM VII: I hereby constitute and appoint my beloved wife Martha L. A. Roberts my sole executrix to carry into effect this my last will and testament. This the 13th Day of Febry, 1868.

Signed, sealed and declared and published by Henry Roberts as his last will and testament in the presence of us the subscribers who subscribed our names as witnesses hereto in the presence of said testator at his special instance and request and of each other.

This the 13th day of Feby. in the year 1868.

In Vacation before me R. T. Ross, Ordinary of said court at Chambers R. W. Bonner and Jas. F. Barron two of the subscribing witnesses to the within instrument of writing who being duly sworn deposes and says that they saw Henry Roberts the testator sign seal and publish and declare the within instrument to be and to contain his true last will and testament - that the testator executed the same freely and without compulsion and that he was at the signing and executing the same of sound mind and memory and that deponents signed the same as witnesses at the request of same testator in his presence and in the presence of each other.
